In brief. Dynavo provides unmanaged Linux KVM VPS instances. You are responsible for your systems, users, content, security, and independent backups. Billing uses prepaid account credit, funded by card payment. The 7-day first-purchase refund described below is returned to your original payment method.
These Terms of Service ("Terms") govern your access to Dynavo's websites, client area, Linux KVM VPS instances, network, support, and related services (together, the "Services"). "Dynavo," "we," "us," and "our" refer to the provider of the Services; "you" and "customer" refer to the person or organization that creates an account, places an order, accepts these Terms, or uses the Services.
By creating an account, funding a balance, placing an order, clicking to accept these Terms, or using the Services, you agree to these Terms and the policies incorporated into them. If you act for an organization, you represent that you have authority to bind it. If you do not agree, please do not use the Services.
1. Service scope
Dynavo provides unmanaged Linux KVM virtual private servers. We do not provide system administration, application management, shared hosting, reseller hosting, or Windows licensing unless a specific order expressly says otherwise.
You are responsible for installing, configuring, licensing, updating, monitoring, and securing your operating system and applications; maintaining firewalls and access controls; responding to abuse and security incidents; confirming that your content and use comply with law and third-party rights; and keeping independent, current, tested backups.
The Services may not be used for life-support systems, air-traffic control, nuclear operations, emergency systems, or other activity where a failure could reasonably result in death, personal injury, or severe environmental damage.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a binding agreement. You must provide accurate, current account, identity, billing, and contact information and keep an email address available for billing, support, abuse, security, and legal notices.
You are responsible for protecting your credentials and for all activity through your account or Services, including activity by your employees, contractors, customers, users, and anyone who gains access through your credentials or systems. Please notify us promptly if you discover unauthorized access, compromised credentials, or a security breach.
You may not use false or misleading information, impersonate another person or organization, use an unauthorized payment method, create accounts to avoid restrictions or unpaid balances, or sell or transfer an account without our written approval.
3. Orders and activation
Orders are subject to acceptance, availability, payment confirmation, and fraud or abuse screening. You are responsible for reviewing the plan specifications before ordering and confirming that they suit your intended use. Provisioning estimates are not guarantees, and activation may be delayed while we complete verification or address capacity and operational requirements.
We may decline, hold, or cancel an order because of availability, failed verification, suspected fraud or abuse, legal restrictions, prior account history, or security concerns. If an order is declined before the service is provisioned, the amount paid for that service will be refunded to your original payment method, subject to amounts you already owe.
4. Acceptable use
Our Acceptable Use Policy ("AUP") is incorporated into these Terms. It includes an explicit prohibition on adult content and rules covering unlawful content, malicious activity, unauthorized access, email, network resources, downstream users, and abuse-response deadlines. A violation of the AUP is a violation of these Terms.
Our Copyright Policy, Privacy Policy, and Service Level Agreement are also incorporated where applicable.
5. Billing and payment
Dynavo operates on a prepaid account-credit model. You add funds to your account balance, and active services draw from that balance. You are responsible for maintaining a sufficient balance to keep your services running. If your balance is insufficient to cover a service when payment is due, that service may be suspended and subsequently terminated.
Dynavo accepts major credit and debit cards, as shown at checkout. Prices are denominated and charged as stated at the time of order. Account credit has no cash value and is not transferable or refundable except as expressly provided below or required by law.
Card payments are subject to authorization by your card issuer and may be declined, delayed, or reversed by the issuer or the payment processor. A payment is credited to your account balance once it settles. You are responsible for any fees charged by your payment method.
We may screen payments for fraud or abuse and may decline, delay, reverse, or require additional verification for a transaction or order. We are not required to disclose a specific screening reason or confidential fraud-detection methods.
6. Cancellation and refunds
You may cancel a service or close your account at any time. Cancellation stops future service after it becomes effective; it does not by itself return payments or unused account credit. Please save any data you need before cancellation because associated storage and IP assignments may be reclaimed and data may be permanently erased.
A 7-day first-purchase refund is available once per customer and is returned to the original payment method. This first-purchase refund does not apply to renewals, repeat orders, or upgrades.
Outside that first-purchase window, payments and account credit are non-refundable. If you paid for a service that Dynavo never provisioned, the amount paid for that service will be refunded to your original payment method regardless of the window above. Dynavo does not offer another refund unless required by law.
If you believe a charge is incorrect, contact us before disputing it with your card issuer so we can investigate and, where appropriate, correct it. If a chargeback or payment dispute is filed, we may suspend the associated services and account while the dispute is open and will provide relevant payment records to the payment processor and card networks. If a dispute is resolved against you, or was filed for services that were provided as described, you remain responsible for the disputed amount and any dispute fees we incur, and we may deduct them from your account credit.
7. Network services and IP addresses
IP addresses, routes, and other network resources are assigned temporarily for use with the Services; they are not sold or transferred to you. We may renumber, replace, withdraw, route, filter, or null-route these resources when reasonably necessary for operations, security, compliance, or provider requirements.
We do not guarantee an IP address's reputation, geolocation, prior history, acceptance by a third-party service, or continued availability. We also do not guarantee a particular carrier, route, latency, peering path, or compatibility with every application or remote network. You are responsible for the reputation of assigned IP addresses while they are used by your service and for resolving blocklist entries caused by your activity.
8. Bandwidth and DDoS mitigation
Each plan includes the resources stated in its order details. If use exceeds the purchased allocation or materially disrupts shared infrastructure, we may rate-limit, restrict, suspend, or ask you to move to a suitable plan. Port speed is a maximum interface rate, not a guarantee of continuous throughput to every destination.
DDoS mitigation is provided on a best-effort basis and cannot detect or prevent every attack. Mitigation may involve filtering, rate limiting, route changes, increased latency, packet loss, null-routing, or temporary interruption. We may restrict or disable an attacked service when reasonably necessary to protect the network, our providers, or other customers, even if you did not cause the attack.
9. Customer data and backups
You retain ownership of your data and content. You grant Dynavo a limited, non-exclusive right to access, transmit, process, copy, or store that data only as reasonably necessary to provide and secure the Services, carry out your requests, investigate technical, fraud, security, or abuse issues, enforce our policies, or comply with law. You represent that you have the rights and permissions needed to store and distribute your content.
Backup coverage depends on your plan. DYN-1 includes no backup service: creating, storing, and testing backups of your data on that plan is your responsibility alone. Plans from DYN-2 upward include backups at the frequency and retention published for that plan, provided on a best-effort basis. An included backup is a shared safeguard, not a guaranteed recovery service, and it does not transfer responsibility for your data to Dynavo. On every plan you remain responsible for maintaining independent, current, tested backups outside Dynavo's infrastructure. A backup may fail, be incomplete, or be unavailable when needed.
Data may be permanently erased after cancellation or termination, during a reinstall or security remediation, when storage is replaced, or when you request a destructive action. Deleted data may not be recoverable.
10. Maintenance and support
The Services may be interrupted by scheduled or emergency maintenance, equipment or software failure, attacks, upstream-provider issues, internet conditions, utility or facility failure, customer configuration, or events outside our reasonable control. We may modify infrastructure, routing, security systems, or providers when reasonably needed. Advance notice of emergency maintenance may not be possible.
Support covers the Dynavo service and hosting infrastructure. Because the service is unmanaged, support does not include administering your operating system, configuring applications, repairing code, managing firewalls, recovering data, or supporting third-party products. Response time may vary with staffing, request volume, maintenance, emergencies, and the nature of the request.
11. Suspension and termination
We may restrict, null-route, suspend, or terminate a service or account for nonpayment; a chargeback or payment dispute as described in Section 6; a violation of these Terms or an incorporated policy; fraud or inaccurate account information; abuse complaints; legal, regulatory, carrier, facility, or provider requirements; compromised or insecure systems; excessive or unauthorized use; a threat to network security or stability; or failure to respond to a time-sensitive billing, abuse, or security notice.
Where reasonably practical, we will provide notice and an opportunity to resolve the issue. We may act immediately when necessary to stop active harm, protect the service or another party, comply with a legal or provider requirement, or address serious fraud, security, or illegal activity.
Suspension may prevent access to the operating system, stored data, network, console, or backups. We are not required to restore a restricted or suspended service temporarily for data retrieval. Restoration is not guaranteed after a service, storage, or IP address has been reclaimed, reassigned, reinstalled, or erased. Suspension or termination for a customer-caused reason does not qualify for a refund except as provided in Section 6.
12. Investigations and legal requests
We may access, preserve, and disclose account, traffic, system, or service information when reasonably necessary to provide support, investigate abuse, fraud, security, or technical issues, enforce our policies, protect Dynavo, our customers, our providers, or the public, respond to an emergency involving serious harm, or comply with law and valid legal process.
We may cooperate with courts, regulators, law enforcement, rights holders, network providers, and other relevant parties where reasonably necessary for those purposes. Personal data is otherwise handled under our Privacy Policy.
13. Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided "as is" and "as available," without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, availability, accuracy, or uninterrupted operation. We do not warrant that the Services will prevent attacks, unauthorized access, data loss, malware, equipment or software failure, network interruption, or third-party conduct. Some exclusions may not apply where applicable law does not permit them.
14. Limitation of liability
To the maximum extent permitted by law, Dynavo and its owners, employees, contractors, suppliers, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; loss, corruption, destruction, or disclosure of data; loss of profits, revenue, customers, opportunities, goodwill, or business; business interruption; substitute services; attacks, malware, third-party conduct, or internet failures; customer configuration or security failures; failed backups or recovery; or reasonable actions taken to enforce our policies or protect the network.
To the maximum extent permitted by law, total liability arising from an affected service will not exceed the amount you paid or owed for one month of that service. These limits apply regardless of legal theory and even if the possibility of damages was known. They do not apply where prohibited by law.
15. Indemnification
You agree to defend, indemnify, and hold Dynavo and its providers, owners, employees, and contractors harmless from claims, damages, liabilities, penalties, judgments, and reasonable legal fees arising from your use or misuse of the Services; your data, content, customers, or users; a violation of our policies or applicable law; infringement of another party's rights; activity through your account or systems; a dispute involving your customers or users; or your failure to secure and maintain your systems.
Dynavo may take control of the defense of a covered claim, and you agree to cooperate reasonably. You may not settle a claim in a way that imposes liability, fault, an admission, or an obligation on Dynavo without written approval.
16. Legal compliance
You may not use, export, re-export, transfer, or provide the Services in violation of applicable sanctions, export-control laws, trade restrictions, or other law. You represent that you are not prohibited from receiving the Services and are not acting for a prohibited person or organization. We may refuse, restrict, suspend, or terminate Services where reasonably necessary to meet these requirements.
17. Notices and changes
We may send billing, renewal, suspension, abuse, service, policy, and legal notices through the client area, a support ticket, the email address on your account, or a notice on our website for matters that apply generally. Please keep your contact information current and monitor your account, tickets, and email. A notice is not invalid merely because it was missed due to outdated information, spam filtering, mailbox limits, or failure to monitor the account.
We may update these Terms and incorporated policies as the service, provider requirements, or applicable law changes. We will revise the date above and provide additional notice for material changes where reasonably appropriate. Continued use after an update takes effect means you accept the revised terms. If you do not agree, you must cancel the affected Services before the update takes effect.
18. Events beyond reasonable control
Neither you nor Dynavo is responsible for a failure or delay caused by events beyond reasonable control, including natural disasters, war, civil unrest, government action, labor disputes, utility or telecommunications failures, internet disruption, cyberattacks, fires, floods, facility failures, transportation interruption, equipment shortages, or third-party-provider failures. This section does not excuse payment already due for Services provided.
19. General provisions
These Terms, the policies incorporated above, and the applicable order details form the complete agreement for the Services and replace earlier statements about the same subject. If order details expressly override a provision for a particular service, those details control only for that service and provision. Otherwise, these Terms control in the event of a conflict unless another policy expressly says it controls for its subject matter.
You may not assign your account, Services, or rights under these Terms without our written approval. We may assign our rights or obligations as part of a merger, financing, reorganization, sale, or transfer of all or part of the business.
A delay in enforcing a provision is not a waiver. If a provision is invalid or unenforceable, it will be modified or removed only to the minimum extent necessary, and the remaining provisions continue in effect. Headings are for convenience only. These Terms do not create a partnership, joint venture, employment, agency, franchise, or fiduciary relationship.
Creating an account, placing an order, clicking acceptance, or using the Services constitutes electronic acceptance. A support ticket, email, chat, or oral statement does not modify these Terms unless an authorized Dynavo representative expressly approves the change in writing. Provisions that by their nature should continue after termination will survive, including those concerning unpaid charges, customer data, ownership, disclaimers, liability, indemnification, and enforcement rights.
