In brief. Send a sufficiently detailed copyright complaint to abuse@dynavo.net. We will review it, identify the affected service where possible, notify the customer, and take appropriate action. Customers may respond with a counter-notification. Repeat infringement may lead to suspension or termination.
This policy explains how Dynavo ("Dynavo," "we," "us," or "our") handles claims that material on a customer's instance infringes copyright and how the customer may respond if they believe a complaint results from mistake or misidentification.
1. Scope
Dynavo provides self-managed Linux KVM VPS infrastructure. Customers select and manage the material stored on their instances; Dynavo does not routinely inspect that material. This policy applies when a complaint identifies material on infrastructure provided by Dynavo. It does not apply to material hosted by an unrelated third party.
2. Copyright contact
Send copyright complaints and counter-notifications to abuse@dynavo.net. This address is Dynavo's operational contact for copyright matters. The page does not identify that inbox as a registered U.S. Copyright Office designated agent.
3. What a valid takedown notice must include
A notice should include enough information to identify the affected service and evaluate the claim:
- A physical or electronic signature of the copyright owner or a person authorized to act for the owner.
- Identification of the copyrighted work claimed to have been infringed, or a representative list where one notice covers multiple works at one site.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it, including the relevant URL, IP address, domain, file location, and timestamps where available.
- The complaining party's name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act for the owner of the allegedly infringed right.
We may request missing information and may be unable to identify the affected service or complete our review until sufficient information is provided.
4. How to submit a notice
Email the notice to abuse@dynavo.net with a subject line identifying it as a copyright complaint. Email is the available submission method.
5. What happens next
When we receive a sufficiently complete notice, we may:
- confirm whether the report identifies a Dynavo service;
- forward the complaint, including the complainant's contact information, to the responsible customer;
- require the customer to remove or disable access to the identified material, submit a counter-notification, or provide information showing that the report does not concern the service; and
- restrict, null-route, suspend, or terminate the affected service if the customer does not respond or appropriately address the complaint.
Because instances are self-managed, the customer is responsible for locating and removing or disabling access to material stored on the instance. A response will generally be required within 24 hours unless our notice states a different deadline. We may act sooner where reasonably necessary to address repeat infringement, comply with law or a provider requirement, or stop another urgent violation under the Acceptable Use Policy.
6. Counter-notification
If material or access was disabled because of a copyright complaint and you believe the action resulted from mistake or misidentification, you may send a counter-notification to abuse@dynavo.net. It should include:
- your physical or electronic signature;
- identification of the material removed or disabled and where it appeared before removal or disabling;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, mailing address, telephone number, and email address; and
- a statement consenting to the jurisdiction of the United States federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district where Dynavo may be found, and agreeing to accept service of process from the person who submitted the original complaint or that person's representative.
We may forward a complete counter-notification to the original complainant. Where the formal U.S. DMCA process applies, access may be restored no sooner than 10 and no later than 14 business days after receipt unless the complainant notifies us that they have filed a court action seeking to restrain the alleged infringement. A counter-notification does not require us to restore a service that remains restricted for another policy violation, security concern, legal requirement, or unpaid balance.
7. Repeat-infringer policy
Dynavo may suspend or terminate customers who repeatedly infringe copyright or repeatedly fail to respond appropriately to copyright complaints. We may consider the number, frequency, apparent validity, severity, and circumstances of complaints. This policy is separate from the broader enforcement rights in our Acceptable Use Policy.
8. Misrepresentation warning
A person who knowingly makes a material misrepresentation in a takedown notice or counter-notification may be responsible for resulting damages, costs, and legal fees under applicable law. Please submit a notice only when you have a good-faith belief that its statements are accurate.
9. Relationship to other policies
This policy operates alongside our Acceptable Use Policy and Terms of Service. Those documents may permit separate action for unlawful, harmful, insecure, or otherwise prohibited activity even when a copyright complaint is incomplete or disputed.
10. Changes to this policy
We may update this policy as our service, provider requirements, or applicable law changes. We will revise the date above and provide additional notice for material changes where reasonably appropriate.
