In brief. You may run lawful Linux workloads that do not harm other people, systems, or the network. Adult content, unsolicited messaging, malicious activity, and illegal content are not permitted. Outbound SMTP ports are blocked on every instance.
This Acceptable Use Policy ("AUP") governs use of Dynavo's services and is part of our Terms of Service. The examples below are not exhaustive. We may reasonably determine that activity violates this AUP when it creates a material legal, security, operational, financial, or reputational risk.
1. Scope and responsibility
You may not use, allow, encourage, promote, or help another person use the service for prohibited activity. You are responsible for activity performed through your account or instances, including activity by people you authorize and activity resulting from compromised credentials, insecure software, or inadequate system security.
If you share access to an instance or provide a service to downstream users, you remain responsible for their activity. You must give those users rules at least as protective as this AUP, respond to complaints concerning them, and take reasonable steps to stop violations.
2. Prohibited content and conduct
You may not use the service for:
- content or activity that violates applicable law;
- adult content or services, whether or not otherwise lawful;
- child sexual abuse material, sexual exploitation of minors, non-consensual sexual content, trafficking, coercion, or unlawful sexual activity;
- fraud, phishing, identity theft, credential theft, card testing or use of stolen payment credentials, scams, deceptive schemes, money laundering, or sanctions evasion;
- credible threats, stalking, unlawful harassment, unlawful invasion of privacy, terrorist activity, or unlawful violent activity;
- unlawful gambling, or the sale or trafficking of illegal drugs, weapons, or controlled materials;
- activity intended to obstruct a lawful investigation or create an unreasonable threat to public safety; or
- content or activity that infringes copyright, trademark, patent, trade secret, privacy, publicity, or another person's legal rights.
3. Security and network abuse
You may not create, host, distribute, control, receive data from, or knowingly facilitate malware, ransomware, botnets, command-and-control infrastructure, credential-stealing tools, denial-of-service attacks, traffic floods, or other malicious code or activity.
You also may not:
- access or attempt to access a system, account, or network without authorization;
- probe, scan, scrape, intercept, monitor, or test third-party systems without permission;
- circumvent authentication, access controls, rate limits, service limits, filtering, billing controls, or security measures;
- forge packet headers, routing information, email headers, or transmission origins;
- spoof or use IP addresses that are not assigned to your service;
- operate an unsecured open proxy, open mail relay, open recursive DNS resolver, or similar service that facilitates abuse; or
- interfere with Dynavo's infrastructure, management systems, monitoring, or another customer's service.
Security and testing tools may be used only against systems you own or have express authorization to test, and only when the activity does not affect Dynavo, other customers, our providers, or unauthorized third parties. Testing Dynavo's own systems or security controls requires our prior written authorization.
4. Email and messaging
Outbound SMTP ports 25, 465, and 587 are blocked on every instance. We do not offer an exception or unblock-request process. For application email, use a reputable third-party transactional email service through its HTTPS API.
Unsolicited bulk messaging, mail bombs, abusive messaging, falsified message origins, harvested recipient lists, and services designed to evade the SMTP restriction are prohibited. Any permitted messaging must use recipients obtained through a valid affirmative-consent process, accurately identify the sender, provide a working opt-out method, honor opt-out requests promptly, and comply with applicable marketing and privacy laws.
5. Network and resource use
You may use only the IP addresses, bandwidth, storage, ports, and other resources assigned to your service. You may not bypass technical restrictions, conceal resource use, obtain more resources than you purchased, or consume shared resources in a way that materially disrupts other customers.
Legitimate VPN, proxy, DNS, crawling, scraping, automation, game-server, and security workloads must be properly secured and operated in compliance with this AUP. Use that causes blocklisting, excessive complaints, attacks, connection attempts, retaliation, or material harm to the network is prohibited. You are responsible for maintaining the reputation of IP addresses while they are assigned to you and for addressing blocklist entries caused by your service.
6. Intellectual property
You may not unlawfully copy, store, publish, torrent, distribute, sell, or make available material protected by intellectual-property rights. This includes counterfeit goods, unlawfully obtained material, and tools primarily intended to defeat lawful copyright protections. Copyright complaints and counter-notifications are handled under our Copyright Policy. Repeat infringement or repeated failure to address valid complaints may result in suspension or termination.
7. Complaints and compromised systems
When we receive an abuse complaint or detect a problem, we review the available information. We may forward the complaint, including the complainant's contact information, to the customer responsible for the service. If we contact you, you must respond within the deadline stated in our notice, which will generally be 24 hours, and take the requested corrective action or provide information showing that the complaint does not concern your service.
We may isolate, filter, restrict, null-route, or disconnect a service reasonably believed to be compromised, insecure, or causing harm. Before reconnecting it, we may require patching, reconfiguration, credential changes, or a complete operating-system reinstall. You remain responsible for backups and any evidence you need to preserve.
8. Investigation and enforcement
Dynavo does not routinely inspect customer content. We may, however, review network traffic, account information, systems, or reported material when reasonably necessary to operate or protect the service, investigate fraud or abuse, comply with law or provider requirements, or enforce our policies.
Depending on the circumstances, we may request correction, block ports or traffic, filter or rate-limit traffic, null-route an IP address, quarantine an instance, require reinstallation, suspend or terminate a service or account, preserve relevant information, report suspected illegal activity, or disclose information as permitted or required by law.
Where practical, we will provide notice and a reasonable opportunity to correct a violation. We may act without advance notice when reasonably necessary to stop active harm, address clearly illegal activity, protect the network or another party, comply with a legal or provider requirement, or respond to a serious security incident. Repeated or unresolved violations may lead to termination. An interruption, suspension, or termination resulting from an AUP violation does not qualify for a refund or service credit.
If activity from your service causes an IP address or range to be blocklisted, we may charge a cleanup fee of up to $250 per incident for documented delisting, reputation remediation, or address-replacement work, in addition to other enforcement available under this AUP.
9. Backups
Backup coverage depends on your plan. DYN-1 includes no backup service, and backing up data on that plan is your responsibility alone. Plans from DYN-2 upward include backups at the frequency and retention published for that plan, on a best-effort basis. A backup may fail, be incomplete, or be unavailable when needed. On every plan you are responsible for keeping current, tested backups of important data outside Dynavo's infrastructure. We are not required to restore a restricted or suspended service temporarily for data retrieval.
10. Indemnification
You agree to defend, indemnify, and hold Dynavo and its providers, owners, employees, and contractors harmless from claims, damages, liabilities, penalties, and reasonable legal fees arising from your use of the service, your content or users, a violation of our policies or applicable law, infringement of another party's rights, or your failure to secure and maintain your systems.
11. Reporting abuse
To report abuse originating from our network, email abuse@dynavo.net. Please include the relevant IP address, URLs or domains, timestamps with time zone, and supporting logs or evidence where available. Specific information helps us review the report promptly.
12. Changes to this Policy
We may update this AUP as the service, our provider requirements, or applicable law changes. We will update the date above and provide additional notice for material changes where reasonably appropriate. Continued use after an updated policy takes effect means you accept the revised AUP. If you do not agree, you must stop using and cancel the affected service.
